What does the pre-litigation assessment cover?

The assessment begins with a review of the relevant contracts, correspondence, and any notices exchanged. We then provide a written advisory that covers the strength of the client's position, the options available (negotiation, mediation, or litigation), and a realistic sense of what each path involves. Where appropriate, we also prepare a letter of demand or response as part of the engagement.

How long does a High Court matter typically take in Malaysia?

Commercial matters at the High Court in Kuala Lumpur can vary considerably. A straightforward case with limited factual dispute may be concluded within 12 to 18 months from filing. More complex matters involving multiple parties, voluminous documents, or procedural applications often run longer. We will give you a considered estimate once we have reviewed the particulars of your matter.

Is mediation presented as an option during litigation?

Yes. Settlement and mediation are revisited candidly at each meaningful stage of the matter. A court proceeding does not prevent settlement — in practice, many commercial matters resolve during the litigation process. We will raise this clearly with you whenever the circumstances suggest it is a serious option worth considering.

What types of commercial disputes do you handle?

Our work covers a range of commercial disputes: contractual breaches, debt recovery, shareholder and partnership disputes, supply chain disagreements, and service-level claims. We also assist with repeat-issue litigation that arises from a particular product line or contract type, which is where the portfolio programme is most useful.

How are fees structured for the portfolio programme?

The portfolio programme is priced at RM 2,250 for the programme engagement, which covers the initial portfolio review, prioritisation, and the first quarter of reporting. Ongoing matter management and individual proceedings carry their own costs, which are discussed and agreed before any work commences. We do not proceed with expenditure that has not been approved.

Is the initial consultation confidential?

Yes. Discussions with our team are treated as confidential from the outset. We will not share information disclosed during a consultation without your knowledge and agreement. Solicitor-client privilege applies once an engagement is formalised.
